  Location Europe (non-EU) — Albania

 The Ministry of Infrastructure and Energy and Central Finance and Contracting Unit (CFCU) in the Ministry of Finance and Economy of Albania is inviting consulting firms/companies focused on telecommunication legal and regulatory aspects, to submit Expressions of Interest related to the implementation the new European Electronic Communications Code & Open Internet for IPA 2015 Action Program for Albania, 2015/038-715, to be implemented under indirect management from Central Finance and Contracting Unit in the Ministry of Finance and Economy in Albania.

The Contracting Authority will be the CFCU in Albania.

The Delegation of the European Union is not involved in the selection /evaluation/ award process but will only carry the ex-post control of the procedure.

Summary Background Information:  This technical assistance will provide support for the Ministry of Infrastructure and Energy and relevant regulatory bodies to align the legal and regulatory framework on electronic communications network and/or services with the newly established European Electronic Communications Code of EU (EECC) and provide capacity building for the staff of the Ministry/regulators that are relevant to the project. The overall objective of the project is to align the Albanian legislation with the Union acquis in the fields of Electronic Communications and open internet access, as part of Albania’s EU accession agenda.

Specific objectives are:

–       To support the Ministry of Infrastructure and Energy of Albania and relevant Regulatory Bodies and authorities to adopt and implement the appropriate legal and regulatory framework in line with Directive (EU) No 2018/1972 of the European Parliament and the Council of 11 December 2018 establishing the European Electronic Communications Code, as well as Regulation (EU) No 2015/2120 laying down measures concerning open internet access

–       New legislation to be drafted in line with Directive (EU) No 2018/1972;

–       The Ministry of Infrastructure and Energy and the relevant Regulatory Bodies of Albania are enabled in implementing the new legislation.

  • – Capacity building for the staff of the Ministry/Authorities that are relevant to the project.
  • – Further develop capacities of the Ministry of Infrastructure and Energy and AKEP and AMA in the implementation of new legislation based on EECC.

 Minimum Requirements: Firms wishing to respond to this Expression of Interest will need to satisfy minimum requirements, along with presenting their qualifications and experience as requested below:

–       The average annual turnover of the candidate over the past three years, for which the candidate’s account is closed, must exceed EUR 300,000.

–       The candidate must have at least 2 staff currently working in the fields related to this contract and 1 staff working for the candidate in the fields related to this contract is permanent.

  • – During the last 3 years up to submission deadline, the candidate has provided technical assistance services under at least 1 (one) project/contract with a budget of at least 250,000 EUR (only the proportion carried out by the candidate will be taken into account) pertaining to support to Public Institutions, Government Authority and/or regulatory bodies in the Telecommunication/Electronic Communication Market regulation in an EU member country, candidate and/or potential candidate country;

Background

The overall objective of the Grant Calls for Proposals is to provide support to the CSO’s and to improve their role in the accession of the Republic of Albania in the European Union.

The specific objectives of the Grant Call for Proposals are:

Ø  To provide  support for the Albanian negotiation process and structures, through studies and research activities;

Ø  To increase policy dialogue between the CSOs and the Albanian public administration, in particular with the structures involved in the upcoming negotiations.

 

Duties and Responsibilities
Central Finance and Contracting Unit in the Ministry of Finance and Economy of Albania has launched a Grant Call for proposal to “Strengthening Policy Dialogue in reform process and EU Integration in Albania”, under IPA 2015 National programme and is also expected to launch a call for proposal under IPA 2017 NP (indirect management) as well.

2 (two) External assessors will be engaged to carry out detailed examination/evaluation of project proposals under the relevant Calls for Proposals (IPA 2015 and IPA 2017 NPs).

For Lot 1: Evaluation of full applications and eligibility check for the applications under IPA 2015 Call for Proposal for civil society expected to be carried out during the period June – September 2019.

–          Assessors will carry out the technical and financial assessment of full applications in accordance with guidelines to be provided by the Contracting Authority and which are based on the published evaluation grids. 30 numbers of full applications are expected. Each full application has to be assessed individually by at least one assessor and one voting member of the Evaluation Committee. (Step 2)

–          Assessors will carry out the eligibility check of the applicants, affiliated entities and the action of the applications that have been provisionally selected, in accordance with guidelines to be provided by the Contracting Authority and which are based on the eligibility criteria set out in the Guidelines for applicants. (Step 3). These assessments will be used by the evaluation committee in the process of selecting the best proposals.

–          Assessors will prepare assessors’ report (with the table of scorings).

For Lot 2: Evaluation of concept notes, full applications and eligibility check for the applications to be received under IPA 2017 Call for Proposal for civil society expected to be carried out during the period June 2019 – December 2020

–           Assessors will carry out the technical assessment of concept notes, in accordance with guidelines to be provided by the Contracting Authority and which are based on the published evaluation grids. 80 numbers of concept notes are expected. Each concept note has to be assessed individually by one assessor and one voting member of the Evaluation Committee (Step 1)

–          Assessors will carry out the technical and financial assessment of full applications in accordance with guidelines to be provided by the contracting authority and which are based on the published evaluation grids. 30 numbers of full applications are expected. Each full application has to be assessed individually at least one assessor and one voting member of the Evaluation Committee. (Step 2).

–          Assessors will carry out the eligibility check of the applicants, affiliated entities and the action of the applications that have been provisionally selected, in accordance with guidelines to be provided by the Contracting Authority and which are based on the eligibility criteria set out in the Guidelines for applicants. Required Skills and Experience

Qualifications and skills:

·        University degree

·        Excellent knowledge of English language, written and spoken(assessors will evaluate project applications written in English and prepare their assessment in English)

·        Good analytical and drafting skills

·        Computer literacy

General professional experience:

  • At least 7 (seven) years of general professional experience

Specific professional experience:

 

  • Have at least 5 (five) years of relevant working experience in EU integration area.
  • Experience related to evaluation of grant project proposals in the framework of call for proposals
  • Knowledge of IPA Programmes and PRAG rules will be considered as an advantage.

Note that civil servants and other staff of the public administration, of the partner country or of international/regional organisations based in the country, shall only be approved to work as experts if well justified. The justification should be submitted with the tender and shall include information on the added value the expert will bring as well as proof that the expert is seconded or on personal leave.
